A member of former Finance Minister Ken Ofori-Atta’s legal team, Frank Davies, has rejected claims that his client is attempting to evade prosecution, insisting that all legal processes must be conducted in accordance with due process.
Speaking on JoyNews following a ruling by U.S. Immigration Judge David A. Gardey, Mr. Davies maintained that the former Finance Minister has not fled justice and remains committed to complying with the law.
“Ken Ofori-Atta is not running away from prosecution. Due process must be followed,” he said.
According to Mr. Davies, the legal team’s position has consistently been guided by respect for the rule of law and adherence to established legal procedures. He argued that any attempt to prosecute or extradite Ofori-Atta must be based on credible evidence and in line with both Ghanaian and international legal standards.
His comments come after Judge David A. Gardey, sitting at the Annandale Immigration Court in Virginia, ruled that Ghana’s Office of the Special Prosecutor (OSP) failed to present persuasive evidence that Ofori-Atta had committed any crime during proceedings relating to his application for adjustment of status.
The ruling has triggered public debate over the OSP’s case against the former Finance Minister, although the Special Prosecutor has maintained that its investigations remain active and will continue in accordance with Ghanaian law.
Mr. Davies insisted that the legal process must not be influenced by public opinion or political considerations, stressing that due process and the rule of law should remain paramount in any proceedings involving his client.
